1. Eligibility
To use KarunyaCare you must:
- Be at least 18 years of age
- Be a resident of India or a jurisdiction where the app is legally available
- Have a valid mobile phone number capable of receiving OTP
- Not be previously banned from using KarunyaCare
Parents or legal guardians may use the app to manage healthcare for their minor children, provided the adult accepts full responsibility under these Terms.
2. Account Registration
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account
- You are responsible for all activities that occur under your account
- Notify us immediately of any unauthorised use of your account
- One account per person — duplicate accounts are prohibited
We reserve the right to suspend or terminate accounts with inaccurate information or that violate these Terms.
3. Services Provided
- Appointment Booking — schedule and manage consultations with doctors
- Video Consultations — real-time video calls between patients and healthcare providers
- Health Records — upload, store, and share medical reports and documents
- Prescription Management — receive and view digital prescriptions
- Patient Management — for healthcare providers to manage patient records
4. Medical Disclaimer
- Doctors on the platform are independent professionals — KarunyaCare is not responsible for their advice or treatment plans.
- Video consultations are not a replacement for in-person examinations where physical assessment is required.
- Recording any consultation without consent of all parties is strictly prohibited and may be illegal.
5. User Conduct
You agree NOT to:
- Provide false, misleading, or fraudulent health information
- Impersonate any person, doctor, or entity
- Upload content that is illegal, harmful, defamatory, or harassing
- Attempt to gain unauthorised access to other users' data
- Reverse-engineer, decompile, or tamper with the application
- Use automated bots or scrapers to access the service
- Record video consultations without explicit consent of all parties
6. Health Data & Consent
By uploading or entering health information into KarunyaCare, you:
- Confirm you have the right to share that information
- Grant us permission to store and process it as described in our Privacy Policy
- Understand that doctors assigned to your case will have access to your health records
- Consent to the use of your data to provide the healthcare services you request
7. Video Consultations
- Camera and microphone access must be granted for video consultations to function
- Video calls use WebRTC (peer-to-peer) — not recorded or stored by KarunyaCare
- You must be in a private, appropriate environment during consultations
- Technical issues due to network conditions may affect call quality — we are not liable
- Joining late may result in a reduced session time
8. Payments & Billing
- Offline Payments Only — all consultation fees, appointment charges, or any other fees are paid directly at the hospital or clinic in person.
- Amounts Shown Are Indicative — any fee, price, or amount displayed within the app is for informational and reference purposes only. These figures may not reflect final billing and are subject to change without notice.
- KarunyaCare bears no responsibility for any payment disputes, refunds, or billing discrepancies — all such matters are handled directly between the patient and the healthcare provider.
- Do not make any payment to any person claiming to represent KarunyaCare through the app — all payments must be made in person at the facility.
9. Intellectual Property
All content, features, and functionality of KarunyaCare are the exclusive property of Spackey Digital and protected by Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the app for its intended purpose. You may not copy, modify, distribute, or create derivative works based on the app.
Content you upload (medical records, reports) remains your property. You grant us a limited licence to store and process it to provide the service.
10. Termination
By You
Delete your account at any time via Profile → Delete Account. Deletion is permanent and irreversible.
By Us
We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent or abusive behaviour, or use the platform in a way that poses risk to other users.
11. Limitation of Liability
To the maximum extent permitted by law, Spackey Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any medical outcomes resulting from consultations.
12. Indemnification
You agree to indemnify, defend, and hold harmless Spackey Digital, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use or misuse of KarunyaCare, your violation of these Terms, or any content you submit through the platform.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India.
- Informal Resolution: Contact us first at spacekeydigital@gmail.com. We will attempt to resolve disputes informally within 30 days.
- Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India.
- Jurisdiction: Legal proceedings shall be subject to the exclusive jurisdiction of courts in India.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will update the "Last Updated" date and notify you via in-app notification for significant changes.
Continued use after changes take effect constitutes acceptance of the revised Terms.
